(Reuters) – The government won an emergency suspension of a ruling that blocked the indefinite military detention of terrorism suspects after arguing it would hurt America’s ability to fight wars overseas.

An appeals court order late on Monday granted a temporary stay sought by the Justice Department after a judge had ruled unconstitutional part of a statute that authorizes indefinite military detention for people deemed to have “substantially supported” al Qaeda, the Taliban or “associated forces.”

The government had asked the 2nd U.S. Circuit Court of Appeals in New York on Monday to freeze the ruling by U.S. District Judge Katherine Forrest.

The Justice Department, which represents U.S. President Barack Obama, argued the judge’s September 12 injunction barring enforcement of a portion of the National Defense Authorization Act’s “Homeland Battlefield” provisions would harm U.S. war efforts abroad.

The case stems from a lawsuit filed in January by former New York Times war correspondent and Pulitzer Prize-winner Chris Hedges and others. They said they had no assurance that their writing and advocacy activities would not fall under the scope of the provisions.

The United States argues that the plaintiffs had no basis to fear being locked up for their activities, and that the judge’s order interfered with the president’s powers at a time of war.

Monday night’s order by Circuit Judge Raymond Lohier said the district court’s order is stayed until an appeals panel considers the issue.

Carl Mayer, a lawyer for Hedges, said Tuesday that the order was procedural and “we are confident the district court opinion will be vindicated.”

A spokeswoman for the U.S. Attorney’s office in Manhattan declined to comment.

The cases are Hedges et v. Obama, U.S. District Court for the Southern District of New York, No. 12-cv-331 and Hedges et v. Obama, 2nd U.S. Circuit Court of Appeals, No. 12-3176.

NYSE Pays a Paltry $5 million Fine for Giving Private Customers a Trading Head Start

On Friday, the U.S. Securities and Exchange Commission (SEC) announced that it had administratively fined the New York Stock Exchange (NYSE) $5 million (pdf) for allowing its private customers access to stock market information ahead of when it was available to the general public. This occurred from June 2008 to about mid-May 2010. The fine amounts to about a morning’s worth of revenue for the exchange.

The SEC stated in its settlement accord that the NYSE had violated SEC Rule 603(a) related to the regulation of national market systems (pdf), which “requires that exchanges distribute market data on terms that are ‘fair and reasonable’ and ‘not unreasonably discriminatory.’ This rule prohibits an exchange from releasing data relating to quotes and trades to its customers through proprietary feeds before it sends its quotes and trade reports for inclusion in the consolidated feeds.”

However, during the period in question, the NYSE allowed customers of its proprietary feeds to receive information from milliseconds to sometimes several seconds ahead of the general public.  An article in the LA Times quoted a trader as saying that allowing this to happen was akin to letting those NYSE customer to see “who won a horse race and being able to bet before everyone else.”

Why did this happen? The SEC said that the NYSE’s internal system’s architecture (pdf) was designed in such a way that allowed its proprietary customers a faster path to the real-time market data than the public. Making matters worse, the SEC said, was a “software issue” in the early to mid-2010 period that slowed down information getting to the public when trading volume was very high.

The SEC also stated that the NYSE did not “systematically monitor its data feeds to ensure they complied with Rule 603(a)” even though the exchange was aware that there could be a 603(a) rule violation as early as in 2009. It wasn’t until early 2010 that the exchange decided that it had better fix its compliance issues, which finally were in 2011.

The NYSE, which didn’t admit or deny the SEC’s allegations, put the blame on the popular corporate excuse of late: “technology issues.” In a statement, NYSE CEO Duncan Niederauer said that, “NYSE Euronext is committed to the highest standards of integrity and accountability.  The timing differentials stemmed from technology issues, not from intentional wrongdoing by the exchange or any of its personnel.”

Maybe not intentional wrong doing, but it looks suspiciously like callous indifference to the public investor at the very least.

The NYSE statement also notes that the SEC hasn’t claimed that the “NYSE data delays caused any investor harm,” but that’s most likely because it is impossible to figure out what the exact harm was and to whom, rather than an indication of no harm being felt by some public investors using the NYSE information.

A former SEC litigator is quoted in the Wall Street Journal saying that although the fine wasn’t large, it was “meant to send a message” to all the exchanges that they need to be fair and non-discriminatory in their business practices.

If that was the intent, it’s likely to have the same effect as telling a teenager to clean up his or her room.

Tungsten-Filled 10 Oz Gold Bar Found In The Middle Of Manhattan’s Jewelry District

It is one thing for tungsten-filled gold bars to appear in the UK, or in Germany: after all out of sight, and across the Atlantic, certainly must mean out of mind, and out of the safe. However, when a 10 ounce 999.9 gold bar bearing the stamp of the reputable Swiss Produits Artistiques Métaux Précieux (PAMP, with owner MTP) and a serial number (serial #038892, likely rehypothecated in at least 10 gold ETFs across the world but that’s a different story), mysteriously emerges in the heart of the world’s jewerly district located on 47th street in Manhattan, things get real quick. Moments ago, Myfoxny reported that a 10-ounce gold bar costing nearly $18,000 turned out to be a counterfeit. The discovery was made by the dealer Ibrahim Fadl, who bought the PAMP bar in question from a merchant who has sold him real gold before. “But he heard counterfeit gold bars were going around, so he drilled into several of his gold bars worth $100,000 and saw gray tungsten — not gold. The bar was filled with tungsten, which weighs nearly the same as gold but costs just over a dollar an ounce.”

What makes so devious is a real gold bar is purchased with the serial numbers and papers, then it is hollowed out, the gold is sold, the tungsten is put in, then the bar is closed up. That is a sophisticated operation.

MTB, the Swiss manufacturer of the gold bars, said customers should only buy from a reputable merchant. The problem, he admits, is Ibrahim Fadl is a very reputable merchant.

Raymond Nessim, CEO Manfra, Tordell & Brookes, said he has reported the situation to the FBI and Secret Service.

The Secret Service, which deals with counterfeits, said it is investigating.

And cue panic on the realization that virtually any gold bar in the world, not just those in Europe and Australia, which have already had close encounters with Tungsten substitutes, but also New York may be hollowed out and have a real worth of a few dollars max. Which, sadly, is fitting considering our main story from last night was the realization that an unknown amount of Chinese iron ore had either never existed or had simply vaporized, and was no longer serving as the secured collateral to various liabilities circulating in the electronic ether. After all, only the most naive out there could conceive of gold being sacrosanct when every other asset class is being diluted to infinity by a regime that has long since run out of money.

As for gold-based transactions on West 47th street: look for that market to grind to a halt at least for as long as it takes for this scandal to be forgotten too.

The only open question remaining will be how much of the gold located 90 feet below Libert 33 is in the same Tungstenized format. For what it’s worth: it is unlikely we will ever find out.

This is what glaring gold counterfeiting looks like.

Half of all medicines being prescribed by doctors in France are either useless or potentially dangerous for patients, according to two eminent medical specialists. They blame the powerful pharmaceutical companies for keeping these drugs on sale at huge expense to the health system and the taxpayer.

Professor Philippe Even, director of the prestigious Necker Institute, and Bernard Debré, a doctor and member of parliament, say removing what they describe as superfluous and hazardous drugs from the list of those paid for by the French health service would save up to €10bn (£8bn) a year. It would also prevent up to 20,000 deaths linked to the medication and reduce hospital admissions by up to 100,000, they claim.

In their 900-page book The Guide to the 4,000 Useful, Useless or Dangerous Medicines, Even and Debré examined the effectiveness, risks and cost of pharmaceutical drugs available in France. Among those that they alleged were “completely useless” were statins, widely taken to lower cholesterol. The blacklist of 58 drugs the doctors claimed are dangerous included anti-inflammatories and drugs prescribed for cardiovascular conditions, diabetes, osteoporosis, contraception, muscular cramps and nicotine addiction.

The Professional Federation of Medical Industrialists denounced the doctors’ views as full of “confusions and approximations”.

“This book is helping to alarm those who are sick needlessly and risks leading them to stop treatments,” it saidin a statement.

Christian Lajoux, the federation’s president said: “It is dangerous and irresponsible … hundreds of their examples are neither precise nor properly documented. We must not forget that the state exercises strict controls on drugs. France has specialist agencies responsible for the health of patients and of controlling what information is given to them.”

Professor Even told the Guardian most of the drugs criticised in the book are produced by French laboratories. He accused the pharmaceutical industry of pushing medicines at doctors who then push them on to patients. “The pharmaceutical industry is the most lucrative, the most cynical and the least ethical of all the industries,” he said. “It is like an octopus with tentacles that has infiltrated all the decision making bodies, world health organisations, governments, parliaments, high administrations in health and hospitals and the medical profession.

“It has done this with the connivance, and occasionally the corruption of the medical profession. I am not just talking about medicines but the whole of medicine. It is the pharmaceutical industry that now outlines the entire medical landscape in our country.”

The French consume medication worth €36bn (£29bn) every year, about €532 (£430) for each citizen who has an average 47 boxes of medicine in cupboards every year. The state covers 77% of the cost; in Britain spending on medicines is around £271 per person. “Yet in the UK people have the same life expectancy of around 80 years and are no less healthy,” said Even.

The authors were commissioned by former President Nicolas Sarkozy to write a report over the Mediator affair, a drug developed for diabetes patients but prescribed as a slimming aid, that has been linked to the deaths of hundreds of patients who developed heart problems.

However, Even accused the industry of having a get-rich-quick attitude to making medicines and said it was interested in chasing only easy profits. “They haven’t discovered very much new for the last 30 years, but have multiplied production, using tricks and lies.

“Sadly, none of them is interested in making drugs for rare conditions or, say, for an infectious disease in countries with no money, because it’s not a big market. Nor are they interested in developing drugs for conditions like Alzheimer’s or Parkinson’s disease because it too difficult and there’s not money to be made quickly.

“It has become interested only in the immediate, in short term gains. On Wall Street, the pharmaceutical industry is third after petrol and banking, and each year it increases by 20%. It’s more profitable than mining for diamonds.”

Asked to explain French people’s apparent dependence on medication, Even said: “For the last 40 years patients have been told that medicines are necessary for them, so they ask for them. Today we have doctors who want to give people medicines and sick people asking for medicines. There’s nothing objective or realistic about this.”

He added: “There is nothing revolutionary in this book. This has all been known for some time.”

Elderly woman asked to remove adult diaper during TSA search

A woman has filed a complaint with federal authorities over how her elderly mother was treated at Northwest Florida Regional Airport last weekend.

Jean Weber of Destin filed a complaint with the Department of Homeland Security after her 95-year-old mother was detained and extensively searched last Saturday while trying to board a plane to fly to Michigan to be with family members during the final stages of her battle with leukemia.

Her mother, who was in a wheelchair, was asked to remove an adult diaper in order to complete a pat-down search.

“It’s something I couldn’t imagine happening on American soil,” Weber said Friday. “Here is my mother, 95 years old, 105 pounds, barely able to stand, and then this.”

Sari Koshetz, a spokeswoman for the Transportation Security Administration in Miami, said she could not comment on specific cases to protect the privacy of those involved.

“The TSA works with passengers to resolve any security alarms in a respectful and sensitive manner,” she said.

Weber’s mother entered the airport’s security checkpoint in a wheelchair because she was not stable enough to walk through, Weber said.

Wheelchairs trigger certain protocols, including pat-downs and possible swabbing for explosives, Koshetz said.

“During any part of the process, if there is an alarm, then we have to resolve that alarm,” she said.

Weber said she did not know whether her mother had triggered an alarm during the 45 minutes they were detained.

She said her mother was first pulled aside into a glass-partitioned area and patted down. Then she was taken to another room to protect her privacy during a more extensive search, Weber said.

Weber said she sat outside the room during the search.

She said security personnel then came out and told her they would need for her mother to remove her Depends diaper because it was soiled and was impeding their search.

Weber wheeled her mother into a bathroom, removed her diaper and returned. Her mother did not have another clean diaper with her, Weber said.

Weber said she wished there were less invasive search methods for an elderly person who is unable to walk through security gates.

“I don’t understand why they have to put them through that kind of procedure,” she said.

Koshetz said the procedures are the same for everyone to ensure national security.

“TSA cannot exempt any group from screening because we know from intelligence that there are terrorists out there that would then exploit that vulnerability,” she said.

Weber filed a complaint through Northwest Florida Regional’s website. She said she received a response from a Homeland Security representative at the airport on Tuesday and spoke to that person on the phone Wednesday.

The representative told her that personnel had followed procedures during the search, Weber said.

“Then I thought, if you’re just following rules and regulations, then the rules and regulations need to be changed,” she said.

Weber said she plans to file additional complaints next week.

“I’m not one to make waves, but dadgummit, this is wrong. People need to know. Next time it could be you.”
